Leaning heavily on the First Amendment and raising election controversies predating the 2020 presidential contest, Fox News Network, LLC on Tuesday filed papers to dismiss a $1.6 billion defamation lawsuit by Dominion Voting Systems over the fallout of the election which removed
Donald Trump from the White House. The motion to dismiss says Fox’s “responsible journalists . . . covered both sides” of the 2020 election controversy and that the network’s opinion hosts provided commentary which “a reasonable viewer” would consider as little more than “hyperbole speculating” about what really happened with the election “rather than [as] factual assertions.”
Fox News Files to Dismiss Dominion Voting Systems’ $1.6 Billion Lawsuit
Fox News on Tuesday asked a court in Delaware to dismiss a $1.6 billion defamation lawsuit from Dominion Voting Systems over the network’s post-2020 election coverage, arguing that the suit would stifle news outlets’ “free-speech right to inform the public about newsworthy allegations of paramount public concern.”
In March, Dominion filed a lawsuit alleging Fox News pundits spread false information about the company’s election machines while also asserting that Fox allowed certain figures, including former President Donald Trump and his lawyers, to make on-air claims about election irregularities during the Nov. 3 presidential election.
